Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between Your Evenings Ltd ("YourEvenings", "we", "us") and the business or individual using our AI receptionist service ("you", "Customer"). By signing up, paying, or using Polly, you agree to these Terms.

1. About us

YourEvenings is operated by Your Evenings Ltd, a private limited company registered in England and Wales under company number 17185055, with registered office at 66 Paul Street, London, England, EC2A 4NA. You can reach us at [email protected].

2. The Service

The Service ("Polly") is an AI-powered telephone receptionist designed for UK tradespeople and similar small businesses. When you forward unanswered calls to your dedicated YourEvenings number, Polly:

The Service is provided as a "best efforts" automated tool. It is not a guarantee that every call will result in a successfully captured job, and it is not a substitute for emergency services. If a caller has a genuine emergency, they should call 999 or the appropriate emergency line.

3. Your account

To use the Service you must:

You are responsible for safeguarding the dedicated number, MMI forwarding codes, and any other credentials we provide. Tell us immediately if you suspect any unauthorised use.

4. Free trial and subscriptions

We offer a 7-day free trial of the Service. No payment card is required to start the trial. At any point during or after the trial you may continue with a paid subscription at £99 (incl. VAT where applicable) per calendar month. Unless you start a paid subscription, the Service ends automatically at the end of the trial period and you will not be charged.

Paid subscriptions renew monthly and continue until you cancel. There is no minimum term and no cancellation fee.

The captured job details, call recordings, and transcripts generated by Polly on your dedicated number ("Customer Data") belong to you. We act as a "data processor" for Customer Data — see our Privacy Policy for full detail on roles, retention, and rights.

We may use Customer Data in aggregated, anonymised form to monitor and improve the Service (for example, to identify common failure patterns and refine Polly's prompts), but we will not share identifiable Customer Data with any third party other than the sub-processors listed in our Privacy Policy.

7. Your obligations to your own callers

Because Polly records and processes the calls of your own customers, you have legal obligations to those callers under UK GDPR and ePrivacy regulations. By using the Service you confirm and warrant that you will:

We may suspend or terminate accounts that breach this section, with or without notice depending on the severity.

9. Service availability

We aim for 99% monthly uptime but make no formal SLA guarantee on the trial or standard subscription. The Service depends on third-party providers (Vapi, Twilio, Cloudflare, Stripe) whose own availability is outside our direct control. In the event of a major outage we will keep customers informed via email.

10. Intellectual property

All intellectual property in the Service — including the Polly AI configuration, system prompts, branding, and software — belongs to YourEvenings or its licensors. We grant you a non-exclusive, non-transferable licence to use the Service for the duration of your subscription. Nothing in these Terms transfers ownership of any of our IP to you.

Customer Data remains yours, as set out in Section 6.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties not expressly stated in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Polly is an automated AI system. We do not warrant that every call will be answered, every job correctly captured, or every SMS delivered. You should review the captured details and consider Polly a useful safety net, not a replacement for your human judgement.

12. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

Subject to the paragraph above, our total aggregate liability to you arising out of or in connection with the Service in any twelve-month period is limited to the greater of:

We are not liable to you for any indirect, consequential, or special losses, including loss of profits, loss of business, loss of goodwill, or loss of anticipated savings.

13. Termination

You may cancel your subscription at any time, with no minimum term and no cancellation fee, by emailing [email protected] or using your account's cancel option. Cancellation takes effect at the end of the current billing month; you will not be charged again.

We may terminate or suspend your account immediately on notice if you breach these Terms, fail to pay, or use the Service in a way that risks our infrastructure or reputation. We may also terminate on 30 days' notice for any other reason.

On termination, we will stop forwarding new calls within a reasonable time. Customer Data is retained or deleted as set out in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. For material changes that affect existing customers, we will email you at least 14 days in advance. Continued use of the Service after a change takes effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising out of or in connection with these Terms or the Service.
